Terms and Conditions for Chester Canalside Holidays

  1. Your holiday contract.

    When you make a booking you, the lead name, guarantee that you have the authority to accept and you do accept on behalf of your party the terms of these booking conditions.

    Your contract with Chester Canalside Holidays is made once the following steps have been completed:

    1.1 The receipt by ourselves of your on-line Booking Form, including the acceptance of the Terms and Conditions.

    Plus

    1.2 The payment of the deposit of 25% of the rental fee, subject to a minimum deposit of 100 pounds sterling. In the case of bookings made within eight weeks of the arrival date, the full amount of the holiday cost must be paid at the time of booking.

    Please note: If your group is all male or all female or a group wholly made up of adults under 25 years old you must contact Chester Canalside Holidays for specific conditions for your booking.

    The Breakage Deposit for Wharton Lock Apartment, 100 pounds sterling, is paid with the balance payment. In the case of bookings made within 8 weeks of arrival this is paid at the same time as the total holiday rental cost, ie on booking.

    The Breakage deposits will be refunded to your bank account. - This is subject to any deductions as detailed below.

    As an alternative to paying a Breakage Deposit, we can hold your Card details subject to a maximum debit of 100 pounds sterling - please contact us for details.

  2. Your holiday payment

    If booking more than 8 weeks in advance of your arrival date then the deposit is due immediately and the balance of your holiday plus the breakage deposit, if applicable, must be paid at least eight weeks prior to your arrival date.

    Failure to make the balance payment on time will result in the cancellation of your holiday.

    Payment may be paid by UK cheque directly to our UK account (provided there is sufficient time to clear the cheque) or bank transfer to our UK account (this will be notified to you at the time of booking). With effect from 16th January 2009 payments can also be accepted by Debit Cards, free of charges. Payments by Mastercard and Visa Credit incur a 2% charge added to your payment. Please contact us for fees for non UK and corporate cards.

    All charges levied by any bank during the payment process for your holiday are the responsibility of yourselves.

  3. If you cancel your holiday

    Should you wish to cancel your holiday booking, written notification must be received from the lead name on the booking form as soon as possible.

    The following charges will apply from the date on which written notification is received by Chester Canalside Holidays to compensate Chester Canalside Holidays for its estimated losses and expenses.

    • More than 56 days prior to your arrival date - Deposit in full
    • Between 28 days and 55 days prior to your arrival date - 50% of the cost of your holiday
    • Between your arrival date and the 27 days prior to it - 100% of the cost of your holiday
  4. If you need to make changes to your holiday

    In exceptional circumstances we will consider changes to your rental dates or number of guests.

    Please contact us if you and your party find yourself in this position.

    These will also be conditional on the following:-

    • Changes will only be considered up to 4 weeks prior to your arrival date.
    • The alternative dates are available.

    No refund will be made in the case of :-

    • Reducing the number of guests
    • Changing to a lower season.
    • Any additional rental cost incurred must be paid as per our normal payment terms.
  5. Your accommodation

    If you have any special requests please contact us prior to the start of your holiday. N.B. In most cases these will be charged for.

    Your booking is reserved for the people named on the booking form and no other persons are permitted to stay or use the property, car park or gardens unless this has been agreed with us in writing and any appropriate payment made. NB: No guest under the age of 18 years old can be in the property at any time without the supervision of an adult aged over 25 years old.

    Please ensure that the property and balcony are left in good condition at the end of your stay so as to enable it to be cleaned and ready for the next guests to enjoy.

    At the end of your stay you MUST leave both the guest keys AND the parking disc on the dining table in the apartment, failure to leave both items will result in your breakage deposit being held until they are received by ourselves and this return must be within 72 hours after your departure (in this event please contact us for address).

    Damage or loss of a Parking Disc will result in a fee being charged of £25.

    You are responsible for any fees charged by the clamping company who monitor the car park at Wharton Court.

    Should you or any member of your party be responsible for any breakages, loss or damage of any item of the property or additional cleaning has been necessary a charge will be made, this will be deducted from you breakage deposit.

  6. Smoking

    All internal and external areas of all properties included in the Chester Canalside Holidays web site are strictly non smoking. There are permanently fitted smoke alarms connected to a main Fire Alarm System for the whole Wharton Court Apartment Block hence any smoking will activate this alarm. If you smoke in the property or on the balcony this will result in the immediate termination of your holiday without refund of rental costs or breakage deposit.

    At all times during your holiday, you are expected to have consideration for all other third parties. If, in our opinion you are, or appear to be, behaving in such a way to cause danger, distress or damage to the property, this includes smoking in any area of the property, we may terminate your holiday arrangements. In this event we will have no further liability to you and we will not be responsible for any expenses you incur, any refund or compensation. In addition you will be responsible for any additional expenses we may incur as a result of your behaviour.

  7. Safety

    Please ensure that all guests at the holiday property are vigilant and safety conscious in the property and balconies.

    In particular youngsters, children and babies should be supervised at all times especially around balconies.

  8. If you have a complaint

    If you have cause for complaint whilst on holiday, this must be brought to the immediate attention of Sandra or Graham Jeffrey at Chester Canalside Holidays on 01244 312788 or 0034 952112270, so that action can be taken to rectify the problem.

  9. Passports visas and health certificates

    Various requirement as to documentation differ from country to country. You are advised to make your own enquires and to be responsible for ensuring that you have all correct documentation for your holiday.

  10. Occupying and vacating the property

    Our properties can be occupied from 15:00 hours onwards and must be vacated by 10:00 hours on the day of your departure.

    All bed linen, blankets, duvets, pillows, bathroom towels, t-towels and cloths are provided in the property.

  11. Freeview / TV / DVD

    If the written description indicates Freeview television you can expect to receive free to air English language channels. Subscription channels are not available.

  12. Services

    Water and electricity are included in the rental cost.

    Unfortunately it is possible to suffer from water or electricity shortage with supplies being cut off with no notice for short periods of time.

  13. Personal Possessions and Insurance

    Please ensure you have suitable Holiday Insurance to cover yourselves and your possessions while staying at our properties, as we accept no responsibility for loss or damage.

  14. Wharton Court has the following conditions in its lease and these must be adhered to during your stay.

    Parking disc, provided on arrival, must be displayed at all times and you may only park in the allocated bay as there is a Wheel Clamping Company in operation.

    Please do not hang clothes or towels out on the balcony or from any window.

    Ball games are not allowed on the grass areas or car park at Wharton Court.

    Please note we ask you to have particular consideration to reduce noise between the hours of 11pm and 8am.
